2.This application for regular bail arises out of Nawada (Town) P.S. Case No. 1412 of 2019, disclosing offences punishable under Sections 20 and 22 of the Narcotic Drugs & Psychotropic Substance Act.

As per the case of the prosecution, on the basis of the information received by the police, raids were conducted at various places including petitioner's kiosk (Gumti). From the said place, the police are said to have recovered 2.58 kilogram of Ganja.

Learned counsel appearing on behalf of the petitioner has submitted that the petitioner is in custody since 07.12.2019 and he does not have any criminal antecedent. He has further

Patna High Court CR. MISC. No.16167 of 2020(2) dt.03-06-2020 2/2 submitted that there is no chance of the petitioner fleeing from the course of investigation, inquiry or trial. He submits that if he is found involved in future with similar allegation against him, the prosecution may proceed for cancellation of bail granted to him in the present case.

Considering the quantity of Ganja said to have been recovered from the petitioner's possession, which is much less than the commercial quantity, this application is allowed. Let the petitioner above-named be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge, Nawada in Nawada Town P.S. Case No. 1412 of 2019.
