JUSTICE ARUN KUMAR ORAL ORDER 23-01-2018 Heard learned Counsel for the petitioner and the State as also the learned Counsel appearing on behalf of the informant. Petitioner, already in custody, seeks bail in Routa PS Case No. 64 of 2017 registered under Sections 364/34 of the IPC. The allegation in brief is that the informant's daughter was married to the petitioner but soon after divorced by him pronouncing Triple Talak and promised to return back Dain Mehr, meanwhile he kidnapped his divorced wife.

Learned Counsel for the petitioner submits that the petitioner already divorced his wife and on account of that he was falsely implicated, she was not recovered from the petitioner's house or possession rather she herself appeared.

Having considered the said facts and circumstances, the petitioner, namely, Ahrar @ Md. Ahrar is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of ACJM II Purnea in connection with Routa PS Case No. 64 of 2017.
