ANJANA MISHRA ORAL ORDER 18-08-2015 Heard learned counsel for the petitioner and the learned counsel for the State.

The petitioner is apprehending his arrest in connection with Vaishali Complaint Case No.1662 of 2014 for allegedly having committed the offence under Sections 498A of the Indian Penal Code and Section 4 of the Dowry Prohibition Act.

Learned counsel for the petitioner submits that the petitioner-husband is willing and ready to keep O.P. No.2 with all honour and dignity and that there shall be no recurrence of any act of mental torture, which includes demand of dowry.

No.32327 of 2015 (2) dt.18-08-2015 2/2 Considering the bona fide offer made by the petitioner, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of three weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur, in connection with Vaishali Complaint Case No.1662 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

However, it is made clear that it will be open to opposite party No.2 to take appropriate steps if at all there is any recurrence of untoward act leading to mental torture to her. (Anjana Mishra, J) PNM U T
