JUSTICE ARUN KUMAR ORAL ORDER 19-01-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Rauta PS Case No. 21 of 2017 registered under Sections 147, 148, 323, 307, 452, 436, 379, 504, 506 and 302 of the IPC.
The allegation in brief is that 14 persons named in the FIR were assaulting nephew of the informant when one Saquib @ Lal Babu came to rescue he too was assaulted who succumbed to injury and they also set fire to the house.
Submission is that there is general and omnibus allegation against the petitioners and later on the informant has said that more than 40 others also participated in the occurrence. Similarly situated other co-accused Md. Ubaid and Md. Shamsad Alam Master have been admitted to bail by a coordinate Bench of this Court. The case of the petitioners also stand on similar footing. Having considered the said facts and circumstances, the petitioners, namely, Md. Firoz Alam @ Md. Firoz, Md. Tajmul @ ajmul and Rafique are directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of ACJM IInd Purnea in connection with Rauta PS Case No. 21 of 2017.
