JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 15-05-2025 At the outset, learned counsel for the petitioners submits that during pendency of this bail petition, petitioner no. 2 namely Ishawari Kumar has been arrested and as such, this petition has become infructuous, so far as petitioner no. 2 is concerned.

2. The anticipatory bail petition stands dismissed, so far as petitioner no. 2 is concerned.

3. The petitioners (i.e. petitioner nos. 1 & 3) apprehend their arrest in a case registered for the offence under Sections 126(2), 115(2), 103(1), 3(5) of the B.N.S., 2023.

4. Prosecution case, in brief, is that on 19.08.2024, all

Patna High Court CR. MISC. No.22326 of 2025(2) dt.15-05-2025 2/2 the F.I.R. named accused persons including petitioners assaulted husband of the informant. It is further alleged that petitioner no. 1 and co-accused Ishwari Kumar and Chintu Kumar sat on the stomach of husband of informant and thereafter, assaulted him.

5. Considering the nature of accusation, the prayer for anticipatory bail of petitioner nos. 1 & 3 is rejected. (Prabhat Kumar Singh, J) anay U T
