JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 18-07-2023 Heard learned counsel for the petitioners, learned APP for the State and learned counsel for the informant. The petitioners have prayed for grant of bail in connection with Sirdalla (Meskaur) P.S. Case No. 07 of 2023 registered under sections 147, 149, 341, 302 and 506 of the Indian Penal Code.

Allegation against the petitioners is that they committed murder of the informant's mother by throttling neck and the reason behind this as alleged offence is said to be land dispute.

Learned counsel for the petitioners submits that the petitioner are innocent and have committed no offence. They

It is further submitted that nothing specific allegation has been levelled against the petitioners rather general and omnibus allegation has been levelled against them. Doctor opined that only one injury was found on the neck of the deceased. It is also submitted that petitioners have got no criminal antecedent. Moreover, they are languishing in judicial custody since 30.01.2023.

The application for bail is opposed by learned APP for the State and learned counsel for the informant. Having heard learned counsel for the parties and considering the facts that the petitioners, being ladies as well as their period of custody, the Court is inclined to enlarge the petitioners on bail. The above named petitioners are directed to be enlarged on bail in connection with Sirdalla(Meskaur) P.S. Case No. 07 of 2023 on each of them furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Nawada.
