The petitioner is seeking regular bail in connection with Phulwarishrif P.S.Case no.46 of 2016, S.T.No.735 of 2016 registered for offences punishable under Section 395 of the Indian Penal Code.

Earlier the prayer for bail of the petitioner was rejected by this Court, vide order dated 2.5.2017 passed in Cr. Misc. No.18955 of 2017 on merit.

Submission of the learned counsel for the petitioner is that he is in custody for more than one year and up-till-now no witness has been examined in this case and other co-accused persons having similar allegation have already been granted bail by this Court.

Patna High Court Cr.Misc. No.55197 of 2017 (3) dt.06-12-2017 2/2 Heard learned A.P.P. also.

Having heard both sides and in view of the fact that earlier his prayer for bail had been rejected on merit and he is accused in seven other cases, I am not inclined to grant bail to the petitioner, however, since he is in custody for more than one year, the learned trial court is directed to expedite the trial and try to conclude it as soon as possible preferably within a period of one year. At the same time, the Sr.S.P., Patna is directed to see that the witnesses are produced in the court on the date fixed so that the trial may be concluded within time.

With the aforesaid observation, this application is dismissed.
