The petitioner is apprehending arrest in a complaint case in which process has been directed to be issued after cognizance being taken for the offences punishable under Sections 376/511 of the Indian Penal Code.

It is alleged that the petitioner being Panchayat Secretary called the complainant in Panchayat Bhawan and tried to ravish her.

It is submitted by learned counsel for the petitioner that the petitioner made complaint on 24.9.2012 against the witnesses

Patna High Court Cr.Misc. No.32585 of 2014 (3) dt.18-03-2015 2/2 cited in the complaint petition on the basis of which Lalganj P.S. Case No. 224 of 2013 was registered and the witnesses have been chargesheeted under section 384 IPC. Hence, those witnesses have set up the present complainant to lodge the present case. It is further submitted that for the occurrence of 5.10.2012 the complaint was filed on 6.10.2012. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. There is nothing on record to suggest that the complainant was medically examined.

Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M. Ist Class, Vaishali at Hajipur in connection with Complaint Case No. 3445 of 2012 subject to the conditions as laid down under Section 438(2) Cr.P.C.
