The petitioner seeks regular bail in connection with Allouli P.S. Case No. 06 of 2019, registered for the offence punishable under Sections 366(A) and 34 of the Indian Penal Code.
The allegation is regarding the accused persons including the petitioner herein having kidnapped the minor victim girl.
The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case and the statement of the victim girl made under Section 164 before the learned Judicial Magistrte, 1st Class, Khagaria would show that she had voluntarily gone to her sister's place
Patna High Court CR. MISC. No.19976 of 2019(2) dt.05-04-2019 2/2 on account of being scolded by her mother. It is submitted that the petitioner is having a clean antecedent and he is languishing in custody since 19.01.2019.
Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.
Accordingly, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria in connection with Allouli P.S.
