2. The petitioner has filed this writ petition seeking a direction to the respondents to grant Matric Trained Scale of Pay to the petitioner notionally from 05.09.1999 and actual benefits thereof from 04.11.2009.

Learned State Counsel by referring to paragraph No. 15 of the counter affidavit filed by the respondent No. 4 has submitted that the petitioner is entitled to be granted Matric Trained Scale of Pay notionally from 05.09.1999 and actual benefits thereof from 31.07.2007 instead of 04.11.2009 as contended by the petitioner. Learned State Counsel, therefore, submits that the petitioner is entitled to be granted Matric Trained Scale of Pay notionally from

Patna High Court CWJC No.4265 of 2023(3) dt.29-04-2025 2/2 05.09.1999 and actual benefits thereof from 31.07.2007.

In view of the submissions made by the learned counsel for the State, since it has been admitted by the respondents that the petitioner is entitled to be granted Matric Trained Scale of Pay notionally from 05.09.1999 and actual benefits thereof from 31.07.2007, this writ petition is hereby disposed off with a direction to the respondents to grant Matric Trained Scale of Pay to the petitioner notionally as well as actual benefits as indicated hereinabove.

5. Insofar as the prayer for grant of senior scale as well as promotion to the petitioner is concerned, learned counsel for the petitioner prays for and is granted liberty to submit a representation before the appropriate authority. As and when such a representation is submitted, the concerned authority shall dispose off the same in accordance with law as expeditiously as possible and in any case not later than two months from the date of receipt of the representation.

6. The writ petition is disposed off with the above directions.
