2.This application for regular bail arises out of Buxar (Town) P.S. Case No. 781 of 2019, disclosing offences punishable under Sections 302, 120 of the Indian Penal Code and Section 27 of the Arms Act.

On careful perusal of the First Information Report, it can be easily noticed that the petitioner is co-brother of the deceased and the informant is the mother of the deceased. Allegedly, the wife of the deceased was unwilling to live with her husband and she preferred to live with her brother-in-law. The deceased was shot dead. The informant has raised a suspicion in the FIR that the petitioner might have got the deceased killed. Apparently, thus, the petitioner has been named

Patna High Court CR. MISC. No.16170 of 2020(2) dt.03-06-2020 2/2 in the FIR only on the basis of suspicion.

Considering the nature of allegation in the FIR, this application is allowed.

Let the petitioner above-named be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Buxar in Buxar (Town) P.S. Case No. 781 of 2019.
