The petitioner is in custody in connection with G.R. No. 1927 of 2018 in connection with Laukahi P.S. Case No. 221 of 2018, registered for the offence punishable under Sections 272/273/34 of the Indian Penal Code and Section 30 (a) of Bihar Excise (Prohibition) Amendment Act, 2016.

Learned counsel for the petitioner submits that the petitioner has no criminal antecedent. Learned counsel for the petitioner further submits that in the instant case total 420 liters of Nepali liquor was seized. Counsel for the petitioner next contended that petitioner was sitting in the tempo as a passenger and he has no concern with the seized liquor or the vehicle. He submits that petitioner is in custody since 07.12.2018.

No.16980 of 2019(2) dt.25-03-2019 2/2 Considering the fact that petitioner has no criminal antecedent and he has remained in custody for more than three months, this Court is inclined to grant bail to the petitioner. Let, the petitioner named above be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. District and Sessions Judge 2nd Cum- Special Judge Excise Act, Madhubani in connection with Laukahi P.S. Case No. 221 of 2018.
