====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 26-06-2023 Heard learned counsel for the petitioners and learned A.P.P. for the State.

The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 341, 323, 324, 307, 448, 504 and 34 of the Indian Penal Code. Learned counsel for the petitioners at the outset seeks permission to withdraw the anticipatory bail application with respect to petitioner no. 1.

Permission is accorded.

The informant alleges that on account of dispute relating to motor pipe an altercation took place in which

No.20931 of 2023(2) dt.26-06-2023 2/3 Ramudgar Sahu assaulted the husband of the informant by farsa causing injury on head and when the informant went to save him, it is alleged that she was also assaulted on head causing injury and Deepak along with Shanti Devi also assaulted by lathi and danda.

Learned counsel for the petitioner no. 2 and 3 submits that petitioners are persons with clean antecedent and petitioner no. 2 is a woman and petitioner no. 3 is her son, it is next submitted that petitioners have been falsely implicated in the present case, it is further submitted that allegation of assault hinges around Ramudgar Sahu and as far as petitioners are concerned, the allegation against them is that they also participated in the occurrence and assaulted. It is further submitted that injuries suffered by the injured are simple but one of the injuries is grievous but then the same is not on vital part of the body.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.

Considering the submissions made by the learned counsel for the petitioner no. 2 and 3, the petitioner no. 2 and 3, in the event of their arrest or surrender before the learned trial court within a period of six weeks from today, be released on

Patna High Court CR. MISC. No.20931 of 2023(2) dt.26-06-2023 3/3 anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Kaluhai P.S. Case No. 95 of 2019 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
