The petitioner is apprehending his arrest in connection with Sasaram (M) P.S.Case No.778 of 2018 registered for offences punishable under Sections 30(a) , 38(1), 41(1) of Bihar Prohibition and Excise Act, 2016.
Allegation as per FIR is of recovery of 3600 ltrs. of foreign liquor from the truck of the petitioner and he is owner of the truck.
Submission of the learned counsel for the petitioner is that he has no knowledge about carrying of liquor from his truck and he has falsely been implicated in this case. Heard learned A.P.P. also.
Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant
Patna High Court CR. MISC. No.16770 of 2019(3) dt.02-05-2019 2/2 privilege of anticipatory bail to the petitioner, however, the petitioner is directed to surrender before the learned court below within a period of six weeks from the date of receipt of the order and make prayer for regular bail, which will be considered by the learned court below on the basis of materials available on record and if possible to be disposed of on the same day. With the aforesaid direction, this application is dismissed.
