The petitioner seeks bail in Bahadurpur (Patour O.P.) P.S. Case No. 537 of 2018, instituted for the offence under Section(s) 30(a), 32(2) and 41(i) of Bihar Prohibition and Excise Act, 2016.
Counsel for the petitioner submits that petitioner is driver of Scorpio vehicle. There is no recovery of any foreign liquor from possession of the petitioner. The seizure list is part of the First Information Report from which it appears that seizure has been made from premises of Shiv Mandir. He further submits that co-accused Sanjay Lal Dev @ Ganauri Lal Dev with similar allegation has already been granted bail by this Court vide order dated 19.2.2019 passed in Cr. Misc. 9847

Petitioner is in custody since 21.12.2018 having clean antecedent.
Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judege-Vth-cum-Special Judge (Excise Act), Darbhanga, in connection with Bahadurpur (Patour O.P.) P.S. Case No. 537 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner. (Sanjay Priya, J) S.Ali/- U T
