2. The petitioner seeks bail in a case registered for offence under Sections 302, 120(B), 34 of the Indian Penal Code and Section 27 of the Arms Act.

3. It is submitted on behalf of petitioner that as per F.I.R. itself, co-accused Raju Singh fired upon the husband of the informant, due to which, he died on spot. So far as this petitioner is concerned, he is alleged to be present at the place of occurrence. No specific overt act has been alleged against this petitioner. Petitioner has got clean antecedent and is in custody since 24.08.2023. Chargesheet has been submitted.

4. Learned A.P.P. for the State and learned counsel for informant opposed the bail petition.

Considering the aforesaid facts and circumstances as well as period of custody, let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. - VIII, Gaya in connection with Konch P.S. Case No. 390 of 2023.
