2.This application for regular bail arises out of Saraiya P.S. Case No. 332 of 2017, disclosing offences punishable under Sections 332,394 of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel for the petitioner has submitted that the petitioner has not been named in the First Information Report. His name has surfaced in course of investigation on the basis of confessional statement of co-accused. He has submitted that name of another co-accused, Abhimanyu Kumar Mahto has also surfaced in course of investigation on the basis of confessional statement, who has been allowed regular bail by this Court by order dated 01.08.2019 passed in Cr. Misc. No.

Patna High Court CR. MISC. No.16187 of 2020(2) dt.03-06-2020 2/2 47174 of 2019. The petitioner is said to be in custody since 11.09.2019. It has also been pointed out that till date no T.I Parade has been held.

Considering the above noted submission and the fact that similarly circumstanced co-accused has been granted regular bail by this Court, this application is allowed. Let the petitioner above-named be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-I, West Muzaffarpur in Saraiya P.S. Case No. 332 of 2017.
