JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 26-06-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner apprehends his arrest in connection with Bochahan P.S. Case No. 195 of 2014 registered under Sections-386, 379 of the Indian Penal Code and Section-17 of C.L.A. Act.
According to the prosecution case itself, the alleged demand was made on 13-02-2014 and the demand was fulfilled on 05-03-2014 but near about after four months of the alleged occurrence, the present case was lodged. The contention on behalf of the petitioner is that the petitioner is own nephew of the informant and as a matter of fact, due to land dispute, the informant has lodged
Patna High Court Cr.Misc. No.12989 of 2015 (3) dt.26-06-2015 2/2 the present case.
Considering the aforesaid facts and circumstances of the case as well as submission of the parties and also keeping in mind that the petitioner does not have any criminal antecedent, let the petitioner named above, in the event of his arrest or surrender within four weeks from the date of receipt/production of copy of the order in the court below, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Bochahan P.S. Case No. 195 of 2014 to the satisfaction of Smt. Divya Vasistha, learned Judicial Magistrate-Ist Class, Muzaffarpur subject to conditions as laid down u/S 438(2) of the Code of Criminal Procedure.
