Heard learned counsel for the petitioner and the learned Additional Public Prosecutor appearing for the State of Bihar.

On 16.11.2019, this Court had granted the petitioner and two others benefit of anticipatory bail with a condition to surrender within four weeks.

Learned counsel for the petitioner submits that due to communication gap, the order could not communicated and the petitioner could not surrender within time, i e, till end of December, 2019. As soon as he came to know of the order, he

Patna High Court CR. MISC. No.17739 of 2020(2) dt.08-09-2021 2/2 rushed to Patna from Delhi where he was earning his livelihood doing a menial job. Therefore, this application has been filed on 16.03.2020. Due to intervening pandemic circumstances, the matter could not be listed.

Petitioner Bhola Ansari is directed to surrender before the Court below, as observed in the order dated 16.11.2019 passed in Cr Misc No 57342 of 2019, within two weeks from today failing which the order of anticipatory bail shall stand cancelled.

Petitioner Bhola Ansari would be obliged to remain present at the trial on a day-to-day basis, in the event he avails the benefit of anticipatory bail, failing which the Court below would pass necessary orders, which may include cancellation of bail bonds.

This application stands allowed, with the aforesaid terms and conditions.
