The petitioner seeks bail in Bounsi P.S. Case No. 217 of 2017 registered under Sections 25(1-b)a, 26 and 35 of the Arms Act.

One loaded country made pistol is said to have been recovered from the possession of the petitioner. It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from conscious physical possession of the petitioner rather he has been falsely implicated in the case at the instance of his enemies. Other accused persons from whose possession cartridge was recovered have been enlarged on bail by this court. The petitioner has been languishing in custody since 01.09.2017. Bail petition of the

Patna High Court Cr.Misc. No.60706 of 2017 (2) dt.13-12-2017 2/2 petitioner was earlier rejected by this court vide order dated 09.11.2017 passed in Cr. Misc. No. 53639 of 2017 with liberty to renew the same after four months or framing of charge whichever happens earlier and now the charge against the petitioner in the case has been framed on 23.11.2017.

Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-III, Banka in connection with Bounsi P.S. Case No. 217 of 2017.
