The petitioner seeks regular bail in connection with Bahadurpur (Patour O.P.) P.S. Case No. 537 of 2018 registered for the offence punishable under Sections 30(a), 32 (2) and 41 (i) of the Bihar Prohibition and Excise Act, 2016. The learned counsel for the petitioner submits that the petitioner is driver of Scorpio vehicle. There is no recovery of any foreign liquor from possession of the petitioner. The seizure list is part of the First Information Report from which it appears that seizure has been made from premises of Shiv Mandir. He further submits that co-accused Sanjay Lal Dev @ Ganauri Lal Dev with similar allegation has already been granted bail by this Court vide order dated 19.02.2019 passed in

Patna High Court CR. MISC. No.17164 of 2019(2) dt.01-04-2019 2/2 Criminal Misc. No. 9847 of 2019. Petitioner is in custody since 17.01.2019 having clean antecedent. It is further submitted that other co-accused persons have already been granted bail by a coordinate Bench of this Court vide orders dated 19.02.2019 and 27.03.2019 passed in Criminal Misc. No. 9847 of 2019 and Criminal Misc. No. 17507 of 2019.

Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-Vth-cumSpecial Judge (Excise Act), Darbhanga in connection with Bahadurpur (Pataur O.P.)
