The petitioner is in custody since 01.06.2018 in connection with Asthawan P.S. Case No. 100 of 2018 for the offence registered under Section 414 of the Indian Penal Code. Learned counsel for the petitioner submits that the allegation against the petitioner is that he was in possession of stolen motorcycle which is entirely false and fabricated and only because the motorcycle was found laying near the field of the petitioner the petitioner has been falsely implicated in the present case. However, there is no recovery from the conscious possession of the petitioner. It is further submitted that the petitioner has no criminal antecedents.
