JUSTICE ARUN KUMAR ORAL ORDER 20-12-2017 Heard learned counsels for the petitioners and the State. The petitioners, already in custody, seek bail in connection with Gaya G.R.P.S.Case No. 52 of 2010 registered under Sections 147, 148, 149, 307, 427 of Indian penal Code and Section 150 and 151 of the Railway Act, Sections 3 and 4 of the Explosive Substance Act and Sect6on 17 of the Criminal Law Amendment Act.

Learned counsel for the petitioners submits that except disclosure of the name of the petitioners by co-accused Badri Yadav in his confessional statement, there is no other material against them and they are in custody since 22.08.2017 and other similarly situated co-accused Bayash Yadav has been granted bail by a co-ordinate bench of this Court vide order dated 15.03.2017 in Cr. Misc. No. 4069 of 2017.

No.61048 of 2017 (2) dt.20-12-2017 2/2 Having considered the aforesaid facts and circumstances, the petitioners, namely, Shambhu Yadav and Brahmdeo Yadav are directed to be released on bail upon furnishing bail bond of Rs. 10,000/- each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Railway, Gaya in connection with Gaya G.R.P.S.Case No. 52 of 2010, with condition that one of the bailors must be their family members. Petitioners shall remain present on each and every date during trial and in case of failure on two consecutive dates, their bail bond shall be liable to be cancelled.
