Petitioner apprehends his arrest in Rajauli P.S. Case No.42 of 2019, registered under Sections 341, 323, 354, 354(B) and 504/34 of the Indian Penal Code.

The informant alleged that while she had gone to a field to attend the call of nature, the petitioner caught her. The petitioner abused and assaulted her with intention to outrage her modesty. On alarm, many persons came there only thereafter the petitioner fled away.

Learned counsel for the petitioner submits that the petitioner is a carpenter. The informant purchased a wooden furniture and some dispute arose for payment of price of the wooden furniture but it appears that the informant made specific allegation that finding her all alone, the petitioner abused and

Patna High Court CR. MISC. No.17699 of 2019(2) dt.26-03-2019 2/2 assaulted her with intention to outrage her modesty and the victim is a minor girl. The witnesses have also supported the manner of occurrence.

Considering the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the prayer for anticipatory bail of the petitioner is rejected. (Prabhat Kumar Jha, J) S.KUMAR/- U T
