Learned counsel for the petitioner undertakes to remove the defects within four weeks of normal court proceedings. In the eventuality of non-removal of defects within undertaken period, the office will place the matter before the Bench.
The petitioner apprehends his arrest in Sour Bazar (Patarghat O.P.) P.S. Case No.43 of 2019, registered for the offences punishable under Sections 341, 323, 307, 504, 506 and 34 of the Indian Penal Code. Later on, Section 302 of the Indian Penal Code was added.
Learned counsel for the petitioner submits that the petitioner is not named in the FIR. During investigation, the
Patna High Court CR. MISC. No.28181 of 2021(2) dt.03-01-2022 2/2 witnesses disclosed the name of the petitioner after five months. It is further submitted that the FIR named accused persons have been granted anticipatory bail vide Annexure-2 series. It is submitted that the petitioner has got no criminal antecedent as stated in para 3 of the bail petition.
Having considered the facts aforesaid, let petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of six weeks from today, be enlarged on bail on furnishing bail bond of Rs.25,000/- (rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Saharsa in connection with Sour Bazar (Patarghat O.P.) P.S. Case No.43 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
