JUSTICE GOPAL PRASAD ORAL ORDER 20-05-2015 Heard learned counsel for the petitioner and learned counsel for the informant as well as learned counsel for the State. The petitioner is apprehending his arrest in connection with Complaint Case No. CA 618 of 2013 registered under Section 376 of the Indian Penal Code.
Learned counsel for the petitioner submits that earlier F.I.R. has been lodged and police after investigation submitted Final Form and after accepting Final Form, the case proceeded on complaint.
Earlier prayer for anticipatory bail application of the petitioner was rejected on the ground that petitioner has been filed quashing application and in the said quashing application, the proceeding of the complaint was stayed by a Bench of this Court.
Patna High Court Cr.Misc. No.37126 of 2014 (2) dt.20-05-2015 However, after dismissal of quashing application, a fresh application has been filed.
Learned counsel for the petitioner submits that both parties have entered into compromise and learned counsel for the complainant also agreed with the above submission. Having regard to the facts and circumstances of the case, the above named petitioner, in the event of his arrest/surrender within a period of four weeks from today in the court below shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Purnea, in connection with C.A. No. 618 of 2013, subject to condition as laid down under Section 438 (2) of Cr.P.C. Further condition that petitioner will appear on each and every date fixed in this case and any absence of the petitioner shall be subject to satisfaction of the court below on reasonable ground.
