The petitioner is in custody in connection with Bhawanipur P.S.Case No.132 of 2017 registered for an offence under Sections 376, 511 and 504 of the of the IPC and Section 8 of the POCSO Act.

It is submitted that the petitioner is villager of the informant and present case has been lodged at the instance of enemy of the petitioner in order to harass him. It is alleged that this petitioner entered into the house of the informant and attempted to commit rape. Petitioner was neither caught at the spot nor any incriminating material has been recovered from the possession. Petitioner is in custody since 01.06.2017

Considering the facts and circumstances of the case, prayer for bail is allowed. Let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Ist ADJ-Cum-Special Judge, Purnea in connection with Bhawanipur (Akbarpur) P.S.Case No.132 of 2017 corresponding to Special Case No.44 of 2017.
