JUSTICE VINOD KUMAR SINHA ORAL ORDER 04-04-2019 Earlier the prayer for bail of the petitioner was dismissed vide order dated 21.12.2018 passed in Cr. Misc. No. 76423 of 2018 with liberty to the petitioner to renew his prayer for bail if the trial is not concluded within a period of three months and there is allegation against the petitioner of recovery of 662 litres of liquor.

Submission of learned counsel for the petitioner is that the period of three months have already expired and the uptil now the trial has not been concluded and petitioner has been in custody since 14.09.2018.

Heard learned A.P.P. also.

Having heard both sides, in view of the above facts, let the petitioner above named, be released on bail on

Patna High Court CR. MISC. No.19223 of 2019(2) dt.04-04-2019 2/2 furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additioanl District & Sessions Judge-II Cum Special Judge, Excise Act, Madhubani in connection with Laukahi P.S. Case No. 164/2018, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds (Vinod Kumar Sinha, J) sunilkumar/- U T
