The petitioner is in custody in connection with Kanti P.S.Case No.371 of 2017 registered for an offence under Sections 25(1-b)a/26 and 35 of the Arms Act.
The allegation as per self statement of police is that this petitioner and two others were apprehended by them in the wee hour of 19.09.2017 in course of patrolling duty. Learned counsel for the petitioner submits that this petitioner is innocent, having clean antecedent. He has apprehended merely on suspicion and nothing has been recovered from his possession. The petitioner is in custody since 20.09.2017. The learned APP opposed the submissions.
Patna High Court Cr.Misc. No.60452 of 2017 (2) dt.19-12-2017 2/2 Considering the clean antecedent of the petitioner facts and circumstances of the case, prayer for bail is allowed. Let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of SDJM, West, Muzaffarpur in connection with Kanti P.S.Case No.371 of 2017.
