JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 15-11-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Earlier the prayer for bail of the petitioner was twice rejected by this Court and while rejecting the prayer for bail of the petitioner on 29.03.2017 passed in Cr. Misc. No. 4576 of 2017, this court had directed the trial court to conclude the trial of the petitioner within six months from the date of receipt/ production of a copy of that order. The impugned order dated 10.10.2017 goes to show that the aforesaid order of this Court was received in the court below on 03.04.2017 and furthermore, the impugned order goes to show that the prosecution has already closed its case and the trial of the petitioner is pending for defence evidence and,

Patna High Court Cr.Misc. No.53716 of 2017 (2) dt.15-11-2017 2/2 therefore, in the aforesaid circumstance, it is obvious that the trial of the petitioner is on the verge of conclusion. Again, I am not inclined to release the petitioner on bail and hence, his prayer for bail in connection with session trail no. 512 of 2016 arising out of Chandi P.S.Case No. 148 of 2016, pending in the court of learned Additional Sessions Judge 1st, Hilsa, Nalanda stands rejected.
