JUSTICE MADHURESH PRASAD ORAL ORDER 19-12-2017 Heard learned counsel for the petitioner and learned APP for the State.

This is a case registered under Sections 147, 148, 149, 341, 323, 307, 353, 436, 427, 504, 153(A), 295(A) and 505(C) of the Indian Penal Code.

It is submitted that a general and omnibus allegation regarding raising slogan and resorting to brick bat by a mob of about 500-700 persons during idol emersion of goddess Durga, has been made. The petitioner is one among the 92 named accused persons. There is no specific allegation against the petitioner and he is in custody since 03.10.2017. Prior to the instant case there is no criminal antecedent of the petitioner and other similarly situated as the petitioner has been allowed bail vide order dated 27.11.2017 in Cr. Misc. No. 55082 of 2017.

Let the petitioner above named be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Sasaram Dist. Rohtas in Nokha P.S. Case No. 299 of 2017 subject to the conditions :

(i) That one of the bailors will be a close relative of the Petitioner who will give an affidavit giving genealogy as to how he is related with the Petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the Petitioner.

(ii) That the Petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail will be liable to be cancelled.
