Petitioner prays for bail in connection with Goraul P.S.Case No. 92 of 2018 registered for the offences punishable under Sections 302, 307 and 34 of the Indian Penal Code. Allegation as per FIR is that two miscreants came on a motorcycle and one of them fired, causing the death of the deceased. Petitioner is not named in the FIR and later on his name transpires in the confessional statement of co-accused. Submission of learned counsel for the petitioner is that his name transpired in the confessional statement of Munna Kumar and Ranjit Kumar and both have been enlarged on bail vide order dated 5.7.2018 in Cr.Misc.No. 34725 of 2018 and vide order dated 6.8.2018 in Cr.Misc.No. 44999 of 2018 and petitioner

Patna High Court Cr.Misc. No.47138 of 2018 (2) dt.20-09-2018 2/2 is in custody since 24.4.2018.

Having heard both sides and in the facts and circumstances, let the petitioner, named above, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Vaishali at Hajipur, in connection with Goraul P.S.Case No. 92 of 2018, subject to the condition that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned.
