The petitioner seeks bail in a case instituted for the offences under Sections 370, 376of the Indian Penal Code, 4, 6, 8 of POCSO Act and 9, 10 and 11 of Child Marriage Prohibition Act, 2006.

The prosecution case in short is that the accused persons committed wrong against the will of the informant. It has been submitted on behalf of the petitioner that the petitioner is in custody since 22.12.2018 and has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. Charge-sheet has been submitted in the present case. The father of the informant got

He has been made accused due to mistake of fact. Other co-accused have been granted bail vide order dated 1.4.2019 passed in Cr. Misc. No. 19644 of 2019 and order dated 27.3.2019 passed in Cr. Misc. No. 17485 of 2019.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R..

Considering the aforesaid facts and circumstances, it is directed that the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge -I-cum- Special Judge, Madhubani in connection with Darbhanga (Jainagar) Rail P.S. Case No. 319/2018, G.R. No. 108/2018.
