The petitioner is in custody since 18.03.2018 in connection with Gayghat P.S. Case No. 68 of 2018 for the offence registered under Sections 399, 402 of the Indian Penal Code and Section 25 (1-b)A/36 of the Arms Act. Learned counsel for the petitioner submits that the petitioner has been taken into custody on pure suspicion and though it is alleged that a countrymade pistol and live cartridge and one mobile have been recovered from his possession, the same has been planted on him and the petitioner is a poor labourer and has nothing to do with the planning of any offence. It is further submitted that the petitioner has not been placed on T.I. Parade

Patna High Court Cr.Misc. No.45376 of 2018 (2) dt.14-08-2018 and the petitioner was made to forcibly put his thumb impression on a plain paper and thereafter, the seizure list was carved out. It is further submitted that the petitioner has no criminal antecedent. Considering the aforesaid facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sub-Judge16-cum-ACJM-15, Muzuffarpur in connection with Gayghat P.S. Case No. 68 of 2018.
