JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 04-06-2020 Heard learned counsel for the petitioner and the learned A.P.P. for the State through Video Conferencing. The petitioner is accused in connection with Patrakar Nagar P.S. Case No. 690 of 2019, registered under Section 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

The accusation is that on 01.09.2019, at about 10.25 A.M., while the informant, Lalti Devi, was present at his door. At that time, her husband Nageshwar Rai was coming at the door after saving from Saloon. At that time, Dablu and Bhallu both resident of Nandlal Chapra, came on motorcycle and Dablu shot fire at the head of her husband, Nageshwar Rai and on another motorcycle, Kedar Rai and Tuntun Gop were also

Patna High Court CR. MISC. No.16026 of 2020(2) dt.04-06-2020 2/2 present. After firing at her husband, all miscreants succeeded to flee away. While her husband was rushed to Sanjivini Hospital but he was declared dead.

Learned counsel for the petitioner submits that petitioner is not named in the FIR but in course of investigation, name of the petitioner has surfaced in the confessional statement of co-accused, Kedar Rai. It is further submitted that petitioner has no criminal antecedent and is in custody since 09.09.2019. Further submission is that the charge sheet has already been submitted against the petitioner.

Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Sub-Judge-VIII-cum-A.C.J.M., Patna, in connection with Patrakar Nagar P.S. Case No. 690 of 2019. Out of two sureties, one surety must be the close relative of the petitioner.
