JUSTICE SUDHIR SINGH ORAL ORDER 28-07-2015 The petitioner is apprehending his arrest in connection with Chauradano P.S. Case No. 36 of 2015 for the offences instituted under Sections 25(1-b)a, 26 and 35 of the Arms Act. Heard learned counsel for the petitioner and learned counsel for the State.

It is alleged that one country made loaded pistol was recovered from possession of co-accused Ramakant Yadav. It is further alleged that this petitioner and Shri Mahto were succeeded in fleeing away from the place of occurrence. It has been submitted on behalf of the petitioner that the petitioner has been named in the F.I.R. on the confessional statement of the co-accused. It is further submitted that there is no

Patna High Court Cr.Misc. No.29607 of 2015 (2) dt.28-07-2015 2/2 recovery from possession of the petitioner.

On behalf of the State it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail in the event of his arrest or surrender before the learned court below within a period of six weeks from today in connection with Chauradano P.S. Case No. 36 of 2015 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned J.M. Raxaul, East Champaran at Motihari, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
