The petitioner seeks bail in connection with Manpur P.S. Case No. 12 of 2017 dated 17.03.2017 instituted for the offences under Sections 25(1-B)a, 26/35 of the Arms Act. The petitioner is said to be in custody since 14.06.2017.

From the FIR as well as seizure list, it appears that one country made pistol was recovered from the bamboo orchard located outside the house of the petitioner; whereas two rifles were recovered from the common house of the petitioner and his son, Bhola Yadav.

Learned counsel for the petitioner submits that weapons were planted at the instance of his agnates, with whom

Patna High Court Cr.Misc. No.49632 of 2017 (3) dt.24-11-2017 the petitioner is having land dispute. The petitioner, earlier, was made accused in three cases and in all those cases he is on bail. Taking into account the period of custody of the petitioner and recovery of the weapons from an orchard outside the house of the petitioner and other weapons from a common house in which many people reside, this Court is inclined to grant bail to the petitioner.

In the facts and circumstances, the petitioner above named is directed to be released on bail on furnishing his bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-V, West Champaran, Bettiah in connection with Manpur P.S. Case No. 12 of 2017.
