The petitioner is apprehending his arrest in connection with Complaint Case No.212C/14 for allegedly having committed the offence under Sections 498A, 341, 323/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that though the petitioner is ready to keep the complainant as his legally wedded wife with full honour and dignity, she has imposed a condition that the petitioner should come and reside in her Maika, which is not acceptable to the petitioner as he has to maintain his old parents. Learned counsel further submits that

Patna High Court Cr.Misc. No.30772 of 2015 (2) dt.11-08-2015 2/2 though in the complaint petition it is stated that she has married with the petitioner in the year 2010, later on she has stated that she has married only a year back, which is contradictory to the fact stated earlier.

Considering the aforementioned submissions and that the petitioner is ready and willing to keep the complainant with all honour and dignity, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of three weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Birpur (Supaul), in connection with Complaint Case No.212C/14, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
