The petitioners seek pre-arrest bail in connection with Jalalpur P.S. Case No. 238 of 2018 registered under Sections 272, 273, 420, 467, 468, 471, 188/34 of the Indian Penal Code and Section 30/30(a) / 41 of the Bihar Prohibition and Excise Act, 2016.

Submission of learned counsel for the petitioners is that the petitioners are innocent and has falsely been implicated in the present case. Nothing has been recovered from the conscious possession of the petitioners. The alleged vehicle from which the recover has been done, does not

Having heard both sides and keeping in view the fact that the alleged vehicle from which the recovery of liquor has been made does not belong to the petitioners, and other facts and circumstances of the case, let the above named petitioners be released on bail, in the event of arrest or surrender, on furnishing bail bonds of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned 6th Additional District and Sessions Judge, Saran at Chapra, in connection with Jalalpur P.S. Case No. 238 of 2018 subject to the conditions as laid down under section 438(2) of Cr. P.C.
