Petitioner seeks bail in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code and 27 of Arms Act.

According to FIR, the petitioner and his son allegedly fired at the brother of the informant, as a result whereof, he died. The reason is that the informant is own brother of the petitioner and there is land dispute between them. Submission of the learned counsel for the petitioner is that the petitioner is in custody since 20.04.2017. Learned counsel for the informant drew attention of this Court towards statement of the witnesses examined before

Patna High Court Cr.Misc. No.49606 of 2017 (3) dt.02-01-2018 the police who supported the allegation against the petitioner as eye witness of the occurrence.

Considering the nature of allegation against the petitioner, I am not inclined to enlarge the petitioner on bail for the present. The trial court is directed to expedite the trial and conclude the same within nine months.

Accordingly, the application is rejected.
