The petitioner is apprehending arrest in a case registered for the offences punishable under Section 395/412 of the Indian Penal Code.

The prosecution case is that informant's Rs.5,89,000/- were robbed, on chase, one Sunil Pathak was apprehended, who disclosed the name of the petitioner as a person flee away from the scene.

It is submitted by learned counsel for the petitioner that the petitioner was not apprehended at the spot and there is no recovery from the petitioner. Moreover, the FIR was registered on 09.02.2015 but it reached to the court of learned ACJM on 11.02.2015 which suggests antedating of FIR.

Patna High Court Cr.Misc. No.30246 of 2015 (2) dt.31-07-2015 2/2 The aforesaid facts constitute good ground for consideration of prayer for regular bail.

Let the learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Jagdishpur P.S. Case No.20 of 2015, pending before the learned Chief Judicial Magistrate, Bhagalpur.

With the above observation, this application is, accordingly, disposed off.
