This application, for grant of anticipatory bail, arises out of Jandaha Police Station Case No. 99/2018, disclosing offences under Sections 341, 323, 356, 357, 379 and 34 of the Indian Penal Code.

Allegation against the petitioner is of assault to the informant and snatching away Rs. twenty one thousand. Submission of learned counsel for the petitioner that he has falsely been made accused in this case and though there is allegation of assault, however, the injury caused to the informant was found to be simple in nature and allegation of snatching Rs. Twenty Five Thousand is only ornamental in nature. Having heard both sides, considering the facts and circumstances of the case, let the petitioner, above named, in the

No.47016 of 2018 (2) dt.13-08-2018 2/2 event of his arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate - Vaishali at Hajipur, in connection with Jandaha Police Station Case No. 99/2018, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure. I.

One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the court concerned.

The petitioners shall cooperate in the investigation and make himself available as and when required by the police and on the event on failure of his part to appear before the police on two consecutive dates, the prosecution will be free to move for cancellation of his bail bonds.
