01-12-2021 Heard learned counsel for the parties.
The petitioner prays for bail in Ladania P.S. Case No. 172 of 2020, registered for the offence under Sections 364 and 34 of the Indian Penal Code.
As per the prosecution case, fifteen unknown persons, riding on three motorcycles, forcibly abducted informant's son. Learned counsel for the petitioner submits that name of the petitioner has come during course of investigation in confessional statement of co-accused. The victim, in his statement recorded under Section 164 Cr.P.C., has not named this petitioner and till date, petitioner has not been put on T.I.P. No incriminating article has been recovered from the possession of the petitioner. Similarly situated three co-accused persons have already been granted bail, vide order dated 30.07.2021
Patna High Court CR. MISC. No.29180 of 2021(3) dt.01-12-2021 2/2 passed in Cr.Misc. No. 27168 of 2021. Petitioner has got clean antecedent and he is in custody since 23.8.2020. Charge sheet has already been submitted.
Considering the aforesaid facts and circumstances, the bail petition of petitioner is allowed. Let the petitioner, abovenamed, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate 1st class, Madhubani in Ladania Police Station Case No. 172 of 2020.
