JUSTICE RAJIV ROY ORAL ORDER 05-09-2022 Heard Mr. Ravindra Kumar, learned counsel for the petitioner and Mr. Nirmal Kumar Sinha, learned counsel for the State and Mr. Madan Kumar, learned APP for the State. The petitioner is in judicial custody in connection with Charpokhri P.S. Case No. 215 of 2021 for the offences under Sections 341, 507, 307 and 34 of the Indian Penal Code and section 27 of the Arms Act.

As per the FIR, specific allegation against the petitioner has been made that he gave a gun shot injury to Krishna @ Pankaj Singh. The reason behind the occurrence is land dispute.

Patna High Court CR. MISC. No.18148 of 2022(3) dt.05-09-2022 2/2 Learned counsel for the petitioner submits that a physical violence has been manipulated to show it a gun shot injury only to make the case serious.

Per contra, learned counsel for the informant submits that not only the injured person has received number of injuries, even he has lost one of his eye due to this incident. Considering all the aforesaid facts including the fact that specific allegation has been made against the petitioner that he opened fire causing injury to the Krishna @ Pankaj Singh, this Court is not inclined to grant him the privilege of bail which is accordingly rejected.
