The petitioner seeks regular bail in connection with Udakishungaj P.S. Case No. 92 of 2017 instituted for the offences under Section 37(b) (c) of the Bihar Excise Prohibition Amendment Act, 2016.
The petitioner is said to have been apprehended in a drunken condition while he was abusing various people. The learned counsel for the petitioner submits that the petitioner is innocent, he has a fair antecedent barring one case in which he is on bail. The petitioner is said to be in custody since 03rd July, 2013.
Considering the nature of accusation and the period of
Patna High Court Cr.Misc. No.63065 of 2017 (2) dt.17-01-2018 2/2 custody already undergone, I deem it fit and proper to enlarge the petitioner above named on regular bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Udakishunganj (Madhepura) in connection with Udakishunganj P.S. Case No. 92 of 2017.
