JUSTICE BIRENDRA KUMAR ORAL ORDER 09-08-2017 The petitioner is a Senior Citizen and has approached this Court for issuance of mandamus commanding respondent no.1 to provide protection and security to the life and property of the petitioner and his wife as well as their daughter, who is a doctor.

In the counter affidavit the State- respondents have clearly stated, on oath, that they would keep strict vigil at the place where protection has been sought by the petitioner. It is further stated that the dispute has already been pacified. Now. the situation is peaceful at the spot.

Since the State cannot deny to protect the life and property of a citizen , the respondent no.3, Senior Superintendent of Police, Patna, and the Officer Incharge of Gardaniagh Police Station are directed to take appropriate steps according to law for protection of life and property of the petitioner.
