Case No.17 of 2011 for committing the offence punishable under Sections 147, 148, 149, 341, 323, 324, 307, 504, 379 and 384 I.P.C.
Apprehending arrest, the petitioners filed A.B.P. No.19/14 before the court of the Sessions Judge, Saharsa. The same was dismissed on 7.7.2014. Hence, this application for grant of anticipatory bail under Section 438 of Cr.P.C. Heard learned counsel for the petitioners and learned A.P.P. for the State.
Patna High Court Cr.Misc. No.37480 of 2014 (2) dt.26-03-2015 2/2 The allegation against the petitioners is that they have brutally assaulted the informant.
It is way back in March, 2011 that the case was registered and since then the petitioners are at large. It is brought to the notice of this Court that the petitioners were declared absconders. At this stage, this Court is not inclined to grant anticipatory bail to the petitioners, but at the same time, the petitioners can surrender before the trial Court, which, in turn, considers the feasibility of granting bail to them on the same day taking necessary undertaking from them to appear before the concerned Police Station in connection with the investigation. Hence, the application is rejected, with the observation that in case the petitioners appear before the trial court within two weeks from today in connection with Pipra P.S. Case No.17 of 2011, the trial court shall consider the feasibility of granting bail imposing necessary conditions, such as, that the petitioners shall appear before the concerned Police Station in connection with the investigation.
