JUSTICE VINOD KUMAR SINHA ORAL ORDER 28-03-2019 Petitioner seeks bail in anticipation of his arrest in connection with Lakhisarai (Khabaiya) P.S. Case No. 321 of 2017, registered for the offences punishable under Sections 272, 273 of the Indian Penal Code and Sections 30(a), 32(C) and 38(b) of Bihar Prohibition and Excise Act.
Allegation is of recovery of 200 litres of liquor from the vehicle of the petitioner.
Submission of learned counsel for the petitioner is that as a matter of fact he sold the vehicle to some other persons but transfer has not been made and other co-accused has been granted privilege of anticipatory bail.
Heard learned APP also.
Having heard both sides and in the facts and circumstances, I am not inclined to grant privilege of
Patna High Court CR. MISC. No.17190 of 2019(2) dt.28-03-2019 2/2 anticipatory bail to the petitioner, rather he should surrender and make prayer for regular bail, which shall be considered on its own merit, without being prejudiced by this order and, if possible, to be disposed of on the same day.
With the above observation, this application is dismissed.
