JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 07-03-2017 The Stamp Reporter pointed out that present appeal has been valued as Rs. 3,88,000/- but the pecuniary jurisdiction of District Judge is up to Rs. 10,00,000/- and, therefore, this appeal should be returned to District Judge.

In view of the aforesaid report, the memo of appeal is returned to the appellants so that the appellants may file appeal before the District Judge, Patna. However, it is made clear that within four weeks from the date of return of memo of appeal the appellants must file the appeal before the District Judge who shall, while computing the period of limitation, condone the period which was spent during pendency of memo of appeal before this Court as well as the above stated period of four weeks.
