JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-10-2018 The petitioners seek bail in connection with Jamalpur P.S. Case No. 152/18, registered for offences punishable under Sections 461 and 379 of the Indian Penal Code. Allegation as per F.I.R. that informant found the lock of his shop broken and when he entered into his shop, he found three persons are trying to commit theft in the shop and the petitioners were caught by the informant and others and was handed over to the police.
It has been submitted on behalf of the petitioners that they have falsely been made accused in this case. They have no criminal antecedents and they are ready to abide by any condition imposed on them for grant of bail.

Considering the aforementioned facts and circumstances, let the petitioners above named, be released on bail on furnishing bail bonds of Rs. 25,000, (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Munger, in connection with Jamalpur P.S. Case No. 152/18, with following conditions:- (i) One of the bailors of the petitioners shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.
(ii) If the petitioners again found involved in such kind of offence, in future, the prosecution will be at liberty to move for cancellation of their bail bonds.
